These Terms apply to all users of the Site, including browsers, customers, purchasers, and individuals who submit photos, reviews, feedback, or other content.

Please read these Terms carefully before accessing or using our Site. If you do not agree to these Terms, you may not access the Site or use our Services.

We may update or replace any part of these Terms by posting an updated version on this page. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

Our store is hosted by Shopify Inc., which provides the ecommerce platform that allows us to offer our products and Services to you.

Payment card information is encrypted during transmission through the payment and checkout providers used by our store.

You may not reproduce, duplicate, copy, sell, resell, scrape, or exploit any portion of the Site or Service without our prior written permission.

The headings in these Terms are included for convenience and do not limit or otherwise affect the provisions below.

SECTION 3 — PRODUCTS AND SERVICES

Our products are offered through ambercase.co and may be available exclusively online.

Amber Case currently specializes in customized photo cases and related accessories designed for compatible iPhone and AirPods models.

Product availability, designs, materials, compatible device models, prices, and specifications may change without notice.

We make reasonable efforts to describe and display our products accurately. However, colors, brightness, image details, transparency, dimensions, and finishes may appear differently depending on your screen, uploaded image, lighting, device settings, and the handmade production process.

We reserve the right to:

  • Limit the sale of products to particular people, regions, or jurisdictions;
  • Limit quantities purchased per customer, household, account, address, or order;
  • Refuse or cancel suspicious, fraudulent, or unauthorized orders;
  • Modify product descriptions or prices;
  • Discontinue products without prior notice.

Any product offer is void where prohibited by law.

SECTION 4 — CUSTOMIZED PRODUCTS

Many Amber Case products are made specifically for each customer using photos or images uploaded during the ordering process.

By submitting an image, you confirm that:

  • You own the image or have permission to use it;
  • The image does not infringe another person’s copyright, trademark, privacy, publicity, or other legal rights;
  • The image does not contain unlawful, abusive, threatening, hateful, sexually explicit, or otherwise prohibited content;
  • You authorize us to use and process the image solely as necessary to produce, fulfill, deliver, and support your order.

You retain ownership of the images you upload. We do not claim ownership of your personal photos.

You grant Amber Case a limited, non-exclusive, royalty-free license to reproduce, crop, resize, adjust, manufacture, store, and otherwise process your submitted image only as reasonably necessary to complete your order, provide customer support, resolve order-related issues, and meet legal or recordkeeping obligations.

We will not use your personal photos in advertising or promotional materials without separate permission.

We reserve the right to refuse or cancel an order containing content that we reasonably believe is illegal, infringing, harmful, inappropriate, or contrary to these Terms.

If an order is refused because the customer submitted prohibited or infringing content, we may issue a refund subject to any non-recoverable payment or processing costs permitted by applicable law.

SECTION 5 — IMAGE QUALITY AND PRODUCT PREVIEWS

Customers are responsible for uploading a clear, properly oriented, sufficiently high-resolution image.

Images that are blurry, dark, heavily compressed, cropped, pixelated, or low-resolution may produce a lower-quality final result.

Any digital preview, mockup, product-page example, or customization preview is provided as a visual guide. The finished product may differ slightly because of:

  • Image cropping and positioning;
  • Screen and production color differences;
  • Device dimensions and camera placement;
  • Handmade assembly;
  • Acrylic and resin finishing;
  • Lighting, reflections, and transparency;
  • Minor variations in placement, texture, thickness, or finish.

Where necessary to manufacture the product, we may make reasonable adjustments to image size, crop, positioning, brightness, or orientation.

Customers should review their selected device model and uploaded image carefully before completing checkout.

SECTION 6 — HANDMADE PRODUCT VARIATIONS

Amber Case products are individually assembled and finished by hand.

Minor differences in positioning, surface texture, resin finish, acrylic alignment, thickness, reflections, or appearance may occur between products. These subtle variations are characteristics of handmade production and make each case unique.

Such variations will not be considered manufacturing defects unless they materially affect the product’s appearance, protective function, fit, or ordinary use.

SECTION 7 — DEVICE COMPATIBILITY

Customers are responsible for selecting the correct iPhone or AirPods model before placing an order.

Model names, dimensions, camera layouts, button placements, and charging-case designs may vary between device generations.

We are not responsible for incompatibility caused by a customer selecting the wrong device model. Eligibility for replacement, return, or exchange is governed by our Refund Policy.

SECTION 8 — ORDERS, BILLING, AND ACCOUNT INFORMATION

You agree to provide current, complete, and accurate information for all purchases made through our store, including your:

  • Name;
  • Email address;
  • Billing information;
  • Shipping address;
  • Phone number, where requested;
  • Device model;
  • Customization selections.

You agree to promptly update any relevant information so that we can process your payment, produce your order, arrange delivery, and contact you when necessary.

We reserve the right to refuse, limit, or cancel an order where we reasonably suspect:

  • Fraudulent or unauthorized activity;
  • Incorrect pricing or product information;
  • Payment failure;
  • Resale or unauthorized commercial purchasing;
  • Duplicate or unusually large orders;

All prices displayed on the Site are subject to change without notice.

The applicable product price is the price displayed at checkout when your order is submitted, except where there is an obvious pricing, technical, or typographical error.

Shipping charges, taxes, customs duties, import fees, and other applicable charges may be displayed or calculated at checkout.

You agree to pay all charges associated with your order.

Payments are processed through Shopify and/or third-party payment providers. Amber Case does not directly store your complete payment card number.

We reserve the right to correct pricing errors and cancel or refund affected orders where permitted by law.

SECTION 10 — ORDER CANCELLATIONS AND CHANGES

Because customized products may enter production shortly after an order is placed, cancellation or modification requests must be submitted as soon as possible.

We will make reasonable efforts to accommodate your request. However, once customization or production has begun, we may be unable to change or cancel the order.

Submitting a request does not guarantee that a change or cancellation can be completed.

SECTION 11 — RETURNS, REPLACEMENTS, AND REFUNDS

Because personalized products are created specifically for each customer, they generally cannot be returned or refunded due solely to:

  • A change of mind;
  • Uploading the wrong image;
  • Selecting the wrong device model;
  • Disliking an image crop that was reasonably necessary;
  • Minor handmade variations;
  • Differences caused by screen color or brightness settings.

This does not limit your rights regarding products that arrive damaged, defective, materially different from the order, or incorrect due to our error.

Return, refund, replacement, eligibility, evidence, and reporting requirements are governed by our Refund Policy.

Nothing in these Terms excludes any consumer right that cannot legally be excluded.

SECTION 12 — SHIPPING AND DELIVERY

Processing and delivery estimates are provided in our Shipping Policy and at checkout where applicable.

Shipping and delivery dates are estimates unless expressly stated otherwise. Delivery may be affected by carrier delays, customs procedures, weather, holidays, address errors, service disruptions, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address.

Amber Case is not responsible for delays or failed delivery caused by:

  • An incorrect or incomplete address supplied by the customer;
  • A customer’s failure to collect a package;
  • Customs delays;
  • Carrier disruptions;
  • Events outside our reasonable control.

If we become aware that an order cannot be shipped within the expected timeframe, we may contact you with an updated estimate or other available options.

SECTION 13 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to third-party tools, integrations, payment services, social media features, customization applications, analytics services, or other technologies.

These services may be provided “as is” and “as available” and may be governed by the third party’s own terms and privacy policies.

We do not control and are not responsible for third-party tools or services except to the extent required by applicable law.

Your use of third-party tools is at your own discretion, and you should review the applicable provider’s terms before using them.

The purchase of a product does not transfer ownership of Amber Case trademarks, copyrighted content, product photography, website designs, or other intellectual property.

If you submit reviews, comments, suggestions, testimonials, ideas, or other non-private feedback, you confirm that your submission:

  • Is accurate and based on your genuine experience;

This clause does not authorize us to use personal photos uploaded solely for manufacturing a customized order.

To the fullest extent permitted by applicable law, Amber Case and its owners, employees, affiliates, contractors, service providers, suppliers, and licensors will not be liable for indirect, incidental, punitive, special, or consequential losses arising from your use of the Site or purchase of our products.

This may include loss of profits, revenue, data, savings, opportunity, or replacement costs, except where such liability cannot legally be limited or excluded.

Where liability cannot be excluded but may be limited, our liability will be limited to the maximum extent permitted by law.

Nothing in these Terms limits liability for fraud, willful misconduct, gross negligence, personal injury caused by negligence, or any other liability that cannot legally be limited.

The remaining provisions will continue in full force and effect.

Termination does not affect rights, payment obligations, or liabilities arising before the termination date.

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and other policies posted on the Site, constitute the entire agreement between you and Amber Case concerning your use of the Site and purchase of our products.

A failure by us to enforce any provision does not waive our right to enforce that provision later.

Amber Case is an independent brand and is not affiliated with, sponsored by, authorized by, or endorsed by Apple Inc.

References to Apple products are used only to describe product compatibility.

SECTION 28 — CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our products, Services, operations, legal obligations, or business practices.

The latest version will be posted on this page with an updated revision date.

Your continued use of the Site after revised Terms are posted constitutes acceptance of those changes, to the extent permitted by law.
